xAI data center case: judge lets NAACP Clean Air Act suit proceed

The dismissal bid failed

A federal judge turned down xAI's request to throw out an NAACP lawsuit. The suit accuses the SpaceX-owned company of operating gas turbines at its Colossus data center outside Memphis without the permits it needed. Judge Debra M. Brown let the claims move forward. The Southern Environmental Law Center is handling the case for the NAACP. The group says xAI installed and ran at least 35 combustion turbines and other air pollution sources at the site without ever getting the required preconstruction or operating air permits. The suit also claims xAI broke the Clean Air Act.

TechCrunch reports that SpaceX was contacted for comment.

xAI's two arguments

xAI made two main points in asking for dismissal. First, it said the turbines are exempt from permitting because they count as mobile. Second, it argued the plaintiffs had no standing to sue. Judge Brown rejected both lines. She wrote that the plaintiffs have statutory standing under the Clean Air Act. She also found the combustion turbines are not mobile sources under Mississippi's State Implementation Plan.

On the constitutional question, xAI claimed citizen suits of this kind are unconstitutional. Brown wrote that citizen suit plaintiffs sue on their own behalf and in their own name. They seek penalties that address harm to themselves, she added, so they are not using the federal government's executive power.

A second denial for the DOJ

The Department of Justice filed a similar motion to dismiss, and that one was denied earlier this month. The NAACP's Abre' Connor, who directs environmental and climate justice at the group, called the ruling another important victory in holding xAI accountable. Connor said the courts have repeatedly rejected attempts by xAI and the DOJ to dismiss the Clean Air Act case. She framed it as affirming the right to pursue justice for communities hit by pollution.

Her position, in her words: xAI cannot run gas turbines without the required permits.

Data centers under pressure

The case moves ahead while public opinion appears to have shifted against data centers. New York recently passed a moratorium on new data centers, and other state and local governments are weighing similar steps. The pushback also led Amazon and Microsoft to promise they would stop using NDAs in their dealings with government agencies.

TechCrunch notes the backlash could be a significant factor in the upcoming U.S. midterm elections. For anyone following AI infrastructure, the ruling keeps a legal challenge to the power setup behind a major data center alive.
